Major County Rules

Manhattan

Commercial Division (22 NYCRR § 202.70 Rule 28): Counsel must pre-mark all exhibits, identify objections with specificity. Trial exhibits at least 14 days before trial. Memoranda must include bookmarks and hyperlinks.

Kings County (Brooklyn)

Clerks may REJECT papers without protruding exhibit tabs. Trial exhibits not retrieved within 30 days of verdict disposed. Video exhibits mailed - not emailed.

Nassau County

Each e-filed exhibit must be separate NYSCEF document. Paper exhibits clearly tabbed, single-sided, no mini-scripts. Max 2 inches thick with litigation back.

Westchester County

That headroom matters for scanned exhibit binders and multi-exhibit combined PDFs, but individual courts and Commercial Division parts can still impose their own stricter formatting rules on top of it.

What does "marked for identification only" mean on a New York exhibit?

Under 22 NYCRR 202.34, counsel must pre-mark exhibits before trial and agree on them where possible. Uncontested exhibits get marked "into evidence"; contested ones are marked "for identification only" until the judge formally admits them during trial.

Does Manhattan's Commercial Division have different exhibit rules than a standard Supreme Court part?
